User Agreement for Kaboyashi Factory LLC

This document, the "User Agreement" (hereinafter referred to as the "Agreement"), constitutes an offer by Kaboyashi Factory LLC, published on the website kaboyashiug.ru (hereinafter referred to as the "Website"), to conclude a contract on the terms set forth below.

1. General Provisions

1.1. By registering on the Website and using its services, you hereby confirm that you are a User of the Website from that moment onward until you personally contact the Website administration with a request to terminate any and all relations with the Website.

1.2. Your use of the Website in any manner and in any form within its declared functionality, including but not limited to:
a) Viewing materials posted on the Website;
b) Registration and/or authorization on the Website, including via the Sber ID service (a functionality of Sberbank PJSC for transmitting User personal data, provided for the purpose of User authentication and auto-filling User data on the Website);
c) Posting or displaying any materials on the Website;
constitutes acceptance of this Agreement and conclusion of a contract in accordance with Articles 437 and 438 of the Civil Code of the Russian Federation.

1.3. By using any of the aforementioned features of the Website, you confirm that:
a) You have read the terms of this Agreement in full before starting to use the Website;
b) You accept all the terms of this Agreement in full without any exceptions or limitations on your part and undertake to comply with them, or you will cease using the Website. If you do not agree with the terms of this Agreement or are not authorized to enter into a contract based on them, you must immediately stop any use of the Website;
c) The Agreement (including any of its parts) may be modified by the Website without any special notice. The new version of the Agreement comes into force from the moment it is posted on the Website or communicated to the User in another convenient form, unless otherwise specified in the new version.

2. General Terms of Website Use

2.1. The Website sells goods and/or services via the web resource kaboyashiug.ru and its associated service functions.

2.2. The Website delivers goods via the methods defined in Section 5 of this Agreement.

2.3. The Website provides access to personalized services to obtain comprehensive information about products, create ratings and reviews, participate in loyalty programs, and other promotions conducted by the Website.

2.4. You hereby provide your voluntary consent to be informed about all actions of the Website related to the sale of goods and/or services, including order status, as well as other events of any nature related to the Website's services.

2.5. Mailing List Consent:
By subscribing to the SMS and email mailing list of kaboyashiug.ru or third parties authorized to send mailings on behalf of kaboyashiug.ru, I agree to receive informational messages to the phone number and/or email address provided during subscription.
I am informed that to unsubscribe, I will need to use the "Unsubscribe" link located in the messages sent from the Website's email address (kaboyashi26@mail.ru) or notify the Website of my wish to unsubscribe using the contact details in the "Contacts" section of this Agreement.
I also grant the Website permission to collect, store, and process my personal data for the purpose of informing me about news and other events.

2.6. You agree that the Website is not responsible for delays, failures, incorrect or untimely delivery, deletion, or non-preservation of any notifications. The Website reserves the right to re-send any notification if it was not received by you.

2.8. You acknowledge that product descriptions on the Website are not exhaustive and may contain inaccuracies. You may send your remarks regarding inaccurate descriptions to kaboyashi26@mail.ru.

2.9. The Website makes reasonable efforts to ensure that the appearance, packaging, and characteristics of goods match their catalog descriptions. However, the actual appearance, packaging, and characteristics may differ from these descriptions for assorted goods or if modifications are made by the manufacturer.

2.10. You are informed that prices and product availability on the Website change continuously without prior notice and are displayed in the individual status and detailed product card within the catalog.

3. User Obligations

3.1. You agree not to use the Website's services to:
a) Upload content that is illegal, violates any rights of third parties, promotes violence, cruelty, hatred, and/or discrimination; contains false information and/or insults against specific individuals or organizations;
b) Incite illegal actions or assist persons aiming to violate restrictions and bans effective in the Russian Federation;
c) Violate the rights of minors and/or cause them harm in any form;
d) Infringe upon the rights of minorities;
e) Impersonate another person or representative of an organization without sufficient rights, including employees of the Website;
f) Misrepresent the properties and characteristics of any goods; make incorrect comparisons of goods or form negative attitudes towards persons using/not using certain goods;
g) Upload content you are not authorized to make available under Russian law or any contractual relationships;
h) Upload content that infringes on any patents, trademarks, trade secrets, copyrights, or other intellectual property rights;
i) Upload unauthorized advertising information and/or spam;
j) Collect and process personal data and private information of individuals;
k) Disrupt the normal operation of the Website;
l) Violate Russian or international law.

3.2. You agree not to use profanity, obscene and offensive images, comparisons, and expressions on the Website.

3.3. You acknowledge and agree that the Website has the right (but not the obligation) to refuse to publish and/or remove any content made available through its services at its sole discretion.

4. Privacy Policy

4.1. The terms of the Privacy Policy and the relations between you and the Website concerning the processing of personal data are governed by Federal Law of the Russian Federation No. 152-FZ of July 27, 2006, "On Personal Data."

4.2. The Privacy Policy applies to personal data that the Website obtained or may obtain from you during registration or order placement, including via Sber ID, and which is necessary for the Website to fulfill its obligations regarding the purchased goods/services and/or your access to the Website's services.

5. Terms of Purchase and Delivery

5.1. You can purchase goods on the Website by paying the issued invoice.

5.2. You agree that the selected payment method cannot be changed after the order is placed on the Website.

5.3. You agree that confirmation of an order paid via invoice occurs only after confirmation of receipt of funds to the seller's bank account.

5.4. You confirm that payment for the order must be made within the agreed period from the moment of its placement on the Website and signing of the contract. You agree that if the order is not paid within this period, it may be canceled.

5.5. The Website delivers goods via the following methods: courier services (CDEK, DPD), transport companies (PEK, KIT), and its own transport.

5.6. You agree that if the transfer of the goods to you is impossible due to your fault, it will be considered as your refusal of the goods. In this case, the goods are returned to the Website, and the order is considered canceled.

6. Liability

6.1. The Website's services may contain links to other resources. You acknowledge and agree that the Website is not responsible for the availability, content, or any consequences of your use of the content of these external resources.

6.2. You agree that the Website is not liable for your personal data which you provide to third-party resources and/or other third parties after following links from the Website.

6.3. You confirm that the Website is not responsible for any possible loss and/or corruption of data that may occur due to your violation of this Agreement or improper access and/or use of the personalized services.

6.4. Responsibility for the actions of minors, including their purchase of goods from the Website's catalog, lies with their legal representatives.

6.5. You agree that the Website shall not be held liable for failure to perform and/or improper performance of its obligations to sell and/or deliver goods to you if such failure is connected with the provision of inaccurate and/or invalid data by you, or your failure to comply with the terms of this Agreement.
